This Policy supplements the Website Terms of Use and the Mobile App Terms of Use. To the extent of any inconsistency between this Policy and those terms as to the standards of conduct and content required of Student Users, this Policy prevails. In relation to all other matters - including the nature of the Services, payments, subscriptions, liability, and our respective legal rights and obligations - the Mobile App Terms of Use prevail.

We may update this Policy from time to time. Any changes will be effective immediately upon posting the updated Policy on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the revised Policy.

3. Nature of the platform

The Platform is a technology service that helps Student Users connect with one another to buy and sell goods and services, share transport, engage with the broader student community, and which provides podcast content and study tools for their own use. We provide the technology only.

transact through the Marketplace Feature, collaborate on Podcast Content, and engage with the broader student community. We provide the technology only.

You acknowledge and agree that:

  1. (a) we are not a transport operator, commercial passenger vehicle service, ride-sourcing service, courier, retailer, marketplace fulfilment provider, agent, broker, financial services provider, employment service, podcast publisher, or media production company, payment facilitator, escrow agent, or collection agent;

  2. we do not provide, supervise, or take responsibility for any journey, transaction, collaboration, or other arrangement made through the Platform;

  3. we do not process or collect any payment for, and do not receive any commission or fare in connection with, any Carpool Match, Marketplace Transaction, or arrangement made through the App. The Platform provides no payment, escrow, settlement, invoicing, collection, or funds-transfer functionality between Student Users, and we do not hold, receive, or handle any money passing between Student Users. The only payment you make to us is the subscription fee, which is processed by a third party as described in our Mobile App Terms of Use;

  4. we do not employ, engage, or contract with any Student User, and no Student User is authorised to act on our behalf;

  5. each Carpool Match, Marketplace Transaction, and arrangement made through the Hustles Feature is a private, voluntary arrangement between the Student Users involved, and any journey, transaction, engagement, or collaboration takes place at the sole risk of the participants; and

  6. because we do not process payments between Student Users, we cannot confirm that any payment has been made or received, cannot reverse, refund, or charge back any payment, and do not offer buyer protection, seller protection, escrow, or a payment dispute resolution service.

We do not verify or confirm the identity, character, background, qualifications, driver licence, vehicle, insurance, financial capacity, ownership of goods, or fitness of any Student User beyond the limited account and student status checks described in clause 4 and in our Mobile App Terms of Use. We make no representation or warranty regarding the conduct, suitability, or trustworthiness of any Student User.

4. Eligibility and account requirements

To use the Platform, you must:

  1. be at least 18 years of age and a current or recently enrolled student at a Tertiary Institution recognised by us;

  2. hold a valid Account with us and comply with our Mobile App Terms of Use and Website Terms of Use;

  3. provide accurate, current, and complete information about yourself (including your name, date of birth, Tertiary Institution, course of study, and contact details), and update that information promptly when it changes;

  4. not create more than one Account, and not impersonate, misrepresent, or assume the identity of another person; and

  5. comply with all applicable laws, regulations, road rules, consumer protection requirements, intellectual property laws, and tax obligations that apply to your use of the Platform.

We may, at our discretion, require additional verification of your age, identity, Tertiary Institution, student status, vehicle, or driver licence before allowing you to access certain features of the Platform (including before allowing you to list through the Hustles Feature or the Marketplace Feature, or offer Carpool Matches). We may engage third party verification services for this purpose. Successful completion of any verification step does not constitute a recommendation or endorsement by us of any Student User.

5. Driver obligations

If you use the Carpool Feature as a Driver, you represent, warrant, and undertake that:

  1. you hold a current and valid driver licence of the appropriate class for the vehicle you use, and you are not subject to any suspension, disqualification, or condition that affects your ability to drive lawfully;

  4. registered with the relevant State or Territory road authority; and

  11. you are solely responsible for any Loss, injury, or damage arising from or in connection with your conduct as a Driver, including any collision, injury, or property damage that occurs during a journey.

Any cost-sharing between you and a Passenger must remain incidental and non-commercial in nature. You must not seek or accept any payment or benefit that would cause the Carpool Feature, or your use of it, to be characterised as a commercial passenger vehicle service, ride-sourcing service, or similar regulated activity in your jurisdiction.

6. Passenger obligations

If you use the Carpool Feature as a Passenger, you represent, warrant, and undertake that:

  1. you will assess and take responsibility for your own safety in deciding whether to accept a Carpool Match or undertake any journey;

Seller obligations

If you use the Marketplace Feature or the Hustles Feature as a Seller, you represent, warrant, and undertake that:

  3. the goods or services you list are not Prohibited Items;

  4. where the goods or services you list are subject to any licensing, registration, recall, safety, or labelling requirement, you hold all required licences and registrations and the goods or services comply with all applicable safety and labelling requirements;

  5. you will provide the goods or services in accordance with the listing and any agreement reached with the Buyer, and you will respond to reasonable enquiries from the Buyer in a timely manner;

  6. you will comply with all applicable tax obligations in connection with amounts you receive in connection with any listing or arrangement made through the Marketplace Feature or the Hustles Feature (including any GST and income tax obligations), and you acknowledge that we do not provide tax advice; and

(a) satisfy yourself as to the identity of the other Student User, and the goods, services, or journey being paid for, before any money changes hands;

(b) not pressure, induce, or require another Student User to pay by a method that cannot be traced or reversed, and not demand payment in full in advance where you have given the other Student User no reasonable basis to trust you;

(c) not use a listing, a Carpool Match, or Messages to obtain money by deception, to solicit a payment for goods or services you do not intend to supply, or to run any advance-fee, overpayment, or refund scam;

(d) not request or accept payment for anything that is a Prohibited Item or that is otherwise prohibited by this Policy; and

(e) report any suspected payment fraud to us under clause 12 and, where the circumstances warrant, to police or Scamwatch.

You acknowledge that we cannot verify, trace, recover, reverse, or refund any payment between Student Users, and that any payment dispute is solely a matter between the Student Users involved.
